1. Introduction

Welcome to Muffins and Mantras. By placing an order with us, you agree to the following Terms and Conditions. Please read them carefully before making any purchases. These terms are subject to change at any time without notice.

2. Orders and Payments

  • All orders must be placed in advance. We recommend placing orders at least 2 days prior to your desired pickup or delivery date for standard orders.
  • Orders are considered confirmed only once full payment is received.
  • Prices are subject to change without notice. The price confirmed at the time of order is the price that will be charged.
  • Customers are responsible for providing accurate and complete information when placing orders. The bakery is not responsible for errors caused by incorrect or incomplete details.

3. Custom Orders and Special Requests

  • Custom orders, including cakes, decorations, and flavors, must be discussed and confirmed in advance.
  • Any special dietary requests (e.g., gluten-free, vegan) must be clearly specified when placing the order.
  • We cannot guarantee the complete absence of allergens in any of our products due to potential cross-contamination risks.
  • Customers are responsible for providing accurate and complete information when placing orders. The bakery is not responsible for errors caused by incorrect or incomplete details.

4. Pickup, Delivery, and Shipping Information

  • Pickup: Customers are responsible for picking up their orders at the designated location and time. The pickup address is 907 Hay St. Ste 100 A, Fayetteville, NC, unless otherwise specified. Pickup times will be confirmed in advance.
  • If the customer is late for pickup, a late fee of $10 may apply, or the order may be forfeited at the bakery’s discretion.
  • Delivery: Delivery is available for an additional fee based on distance. Please specify your delivery address when placing your order. Delivery times will be confirmed, but we are not responsible for delays caused by weather or other unforeseen circumstances.
  • A delivery fee will apply, depending on the location. Delivery times are estimates and may vary.
  • If the customer or designated recipient is not available at the time of delivery, the order may be forfeited at the bakery’s discretion.
  • A minimum order amount of $50 may apply for delivery orders.
  • Shipping: Shipping options are available for select items. Please inquire about shipping availability, rates, and estimated delivery times when placing your order. Shipping fees will vary depending on the destination and size of the order.
  • Damage During Shipping: While we take great care in packaging our products for shipping, we are not responsible for any damage that may occur during the shipping process. Once the product leaves our bakery, we cannot control how it is handled. Please contact the shipping carrier directly in case of any damage during transit.

5. Subscription Service 

  • Subscription Start Date & Fulfillment Timing
  • Monthly Subscriptions: Monthly subscription orders will be fulfilled on the second Saturday of each month. However, if you subscribe after the second Friday of the month, your first fulfillment will occur on the second Saturday of the following month. This allows for a two-week fulfillment notice, so if you subscribe after the second Friday, please expect your first delivery or pickup to occur the following month's second Saturday.
  • Weekly Subscriptions: Weekly subscription orders will be available for pickup on each Saturday of the week. If you subscribe after the start of a week, your first pickup will be available on the following Saturday.
  • Pick-Up Orders:
  • Monthly and weekly subscription orders designated for pickup will be available at the designated pickup location.
  • Monthly subscription orders will be available for pickup on the second Saturday of each month.
  • Weekly subscription orders will be available every Saturday starting at 9:00 AM.
  • Shipping Orders:
  • Monthly orders designated for shipping will be mailed on the respective fulfillment day.
  • Monthly orders will ship on the second Saturday of each month.
  • Shipping times may vary depending on your location, and we are not responsible for shipping delays caused by the carrier.
  • Monthly Variety Boxes:
  • Monthly variety boxes will be fulfilled on the second Saturday of each month, in alignment with our monthly subscription schedule.
  • These boxes will be available for pickup or shipped on the second Saturday of each month.

6. Cancellations and Refunds

  • Standard Orders:
  • Cancellations for standard orders made at least 24 hours before the scheduled pickup or delivery will receive a full refund.
  • Cancellations made less than 24 hours in advance will not be refunded.
  • Refunds are not provided for orders that are fulfilled but not picked up or accepted by the customer.
  • Custom Orders:
  • A 50% non-refundable deposit is required for custom orders. The remaining balance is due 7 days before the scheduled pickup or delivery.
  • Cancellations made at least 3 days before the scheduled pickup or delivery will receive a partial refund. If specialty items have been purchased (e.g., custom cake toppers), the refunded amount will be reduced by this cost. The customer will have the option to pick up the item.
  • Cancellations made less than 3 days in advance will not be refunded.
  • Refunds are not provided for orders that are fulfilled but not picked up or accepted by the customer.
  • Orders that have not been fully paid will not be fulfilled.
  • Subscription Orders:
  • Monthly Subscriptions:
  • Cancellations for monthly subscription orders must be made at least 14 days before the next scheduled fulfillment date (second Saturday of the month). Cancellations made after this time will apply to the following month.
  • Refunds will not be provided for monthly subscription orders that are processed and shipped or fulfilled.
  • No partial refunds will be given if the subscription has already been partially fulfilled.
  • Weekly Subscriptions:
  • Cancellations for weekly subscription orders must be made at least 7 days before the scheduled Saturday pickup or shipping date.
  • No refunds will be provided for weekly subscription orders that are processed and shipped or fulfilled.
  • If the subscription is canceled after the start of a week, the customer will receive the following week’s subscription but no refund for the canceled week.
  • Failure to Accept Subscription Deliveries:
  • If a customer fails to pick up or accept their subscription delivery, the order will be forfeited and no refunds will be provided.

7. Quality and Liability

  • We take great care to ensure the highest quality of our products. Your order will be confirmed and fulfilled based on your confirmation of that order.
  • We are not responsible for any damages to the product once it has been picked up or delivered.
  • Our products are prepared in a home kitchen and may contain allergens such as dairy, eggs, nuts, and gluten. Please consult the ingredients list or contact us with any concerns regarding allergies.

8. Storage and Shelf Life

  • All baked goods are best consumed within 3 to 5 days of pickup or delivery. For best freshness, we recommend storing items as instructed upon receipt (e.g., in an airtight container, refrigerating cakes, etc.).
  • The bakery is not responsible for the freshness or quality of products once they have left our premises.

9. Privacy and Data Collection

  • We respect your privacy and are committed to protecting your personal data. Your contact information will be used only for order-related purposes and will not be shared with third parties without your consent, except as required by law.
  • By placing an order, you consent to receiving occasional promotional emails and updates about our products.

10. Liability

  • We are not liable for any indirect, incidental, or consequential damages arising from your purchase, including but not limited to damages from delivery delays, allergies, or dissatisfaction with the product.
  • Customers are responsible for checking the order upon pickup or delivery. Any issues should be reported immediately.

11. Changes to Terms and Conditions

  • We reserve the right to modify these Terms and Conditions at any time. Any changes will be posted on this page with an updated revision date.

12. Intellectual Property

  • All images, content, and logos on this site are the property of Muffins and Mantras and may not be used without permission. Any custom designs or decorations created for an order are the property of Muffins and Mantras, and the customer may not reuse the design for commercial purposes.

13. Force Majeure

  • We are not liable for any failure to deliver or delays in fulfilling orders due to unforeseen circumstances, including but not limited to natural disasters, pandemics, or other events beyond our control.

14. Age Restrictions

  • You must be at least 18 years old to place an order for certain products, such as those containing alcohol, if applicable.

15. Governing Law

  • These Terms and Conditions are governed by the laws of the state of North Carolina, and any disputes will be resolved in the courts located in Fayetteville, NC.
